Bankrutpcy -- A Chapter 7 or Chapter 13 bankruptcy may allow you to reorganize your personal finances, catch up on your mortgage and car loans, and get rid of unpaid medical bills, credit cards, and most other unsecured debts. With a few exceptions, a Chapter 7 or 13 filing will immediately stop all collection activity, including wage garnishments, pending lawsuits, and foreclosures, even if a judgment has been entered against you. Collection lawsuit defense -- If you fall behind on your credit cards, medical bills or other debts, you probably will be sued at some point. If that happens, you will have a limited time to respond, or the company that filed the suit may take a "default" judgment against you. Fair Debt Collection Practices Act (FDCPA) -- If you owe a debt, you probably will be pursued by a debt collector or collection law firm. While debt collectors have a right to engage in collection activity, there are limits on what they can say or do. If they cross the line into illegal collection methods, you may have a claim against them under the federal Fair Debt Collection Practices Act (FDCPA).
